Consent Agreement

The following terms and conditions of sale (“these terms and conditions”) will apply to and bind the purchaser of any product of The Big Things Playground Limited.

IMPORTANT NOTICE – THESE CONDITIONS AFFECT YOUR LEGAL RIGHTS!

The Big Things Playground Limited as the supplier of recreational services, sells all tickets and supplies all recreational services and facilities to you (the “Customer”) including, but not limited to slides, climbing walls, gymnastics area, tube slide and maintenance, the conditions, layout, construction, design, maintenance and use of facilities, the presence of people or objects thereon, the surrounding areas and any other associated sporting activities or similar leisure time pursuits (“Activities”) in The Big Things Playground Limited (“TBT”) venue subject to the following these terms and conditions:

By purchasing a ticket for or by using any of the facilities at the TBT venue, the Customer on his/her own behalf and on behalf of (i) any other participant for whom the Customer is purchasing a ticket; and (ii) any person accompanying the Participant(s), agrees to be bound by these terms and conditions. 
Tickets and other entitlements are non-transferable, non-exchangeable, non- refundable, revocable, and void if altered.


To participate in the Activities, guests must be between 2 and 8 years of age (the “Participant(s)”) and be accompanied by at least one paid adult (aged 16 or above) when entering the TBT. Every and all accompanying adults collectively take responsibility for the Participant(s)’s safety and must directly supervise him/her/them at all times in the TBT venue (the “Supervisor”).


The Customer confirms the Participant(s)’s involvement and/or participation in the Activities is voluntary, and the Customer is under his/her own free will and on behalf of the Participant(s) in his/her/their capacity as parent, guardian1 or adult that has granted permission the Participant(s)’s parent(s) or guardian(s) (as the case may be) to assume responsibility for that participant.


The Participant(s)’s participation in the Activities may be physically demanding, and the inherent risks and hazards from participating in the Activities is significant, including the potential for infectious diseases, including Covid-19 and other infectious diseases that may be prevalent from time to time, serious bodily injury, permanent disability, paralysis and loss of life, and there is potential for risks and hazards that may not be obvious or reasonably foreseeable at this time (“such risks”). Such risks cannot be eliminated entirely without jeopardising the essential qualities of the Activities and that while particular rules, equipment and self-discipline may reduce such risks, such risks do still exist.


The Participant(s) must be in good health and free from any adverse medical 
1 “guardian” has the same meaning as in the Guardianship of Minors Ordinance (Cap. 13) of Hong Kong Special Administrative Region conditions that make it dangerous to participate in the Activities in a safe manner for himself/ herself or others and that if the Customer(s) and/or the Supervisor(s) has any concerns in this regard, TBT has been informed or will beinformedpriortotheParticipant(s)’sundertakinginanyoftheActivities. For health and safety reasons :-

pregnant women, persons with pre-existing health issues or wearing of casts are permitted to enter the TBT venue but are not permitted to take participation in any of the Activities or use any of the equipment in the TBT venue;


Participant(s) suffering from any disease within a previous 24-hour time frame (including, but not limited to fever, cough, cold/flu, nausea, diarrhoea, vomiting, rash, skin disease, heart disease, lung disease, haemophilia, epilepsy) are not recommended to participate in the Activities; 
guests suffering from any infectious disease specified in the First Schedule to the Prevention and Control of Disease Ordinance (Cap 599 of the laws of Hong Kong) Remark 1 will not be allowed to enter the TBT venue; 
guests that were in touch with a suspected or confirmed case of COVID- 19 will not be allowed to enter the TBT venue;


TBT will check guests’ temperature before entry to the TBT venue and will refuse the entry if the temperature equal or higher than 37.4°C; all guests must wear face mask during the entire experience; and 
to safeguard all guests, TBT reserves the right to refuse entry, or to request any guests displaying symptoms to leave the TBT venue in case of such necessities. 
If in doubt, please seek medical advice.

The Participant(s) and the Supervisor(s) may be liable to other individuals for their injuries, if such injuries arise from irresponsible, deliberate or reckless behaviour of the Participant(s) and/or the Supervisor(s). The Customer and/or the Supervisor(s) must pay for any damage caused to any equipment at the TBT venue as a result of irresponsible, deliberate or reckless behaviour of the Participant(s) and/or the Supervisor(s). 
To reduce such risks, the Participant(s) and the Supervisor(s) must: –


a. follow the General Playground Policy and the Play Rules of TBT, including the rules posted in and around the TBT facility and on the TBT website, and all instructions given to the Participant(s) and the Supervisor(s) by TBT before and during the Participant(s)’s participation in the Activities, including, without limitation, on any safety videos that are playing in and around the TBT facility or on the TBT website, which may be amended from time to time by TBT (the “Rules”);


use all equipment at the TBT venue in a responsible manner, and with respect for their own safety and the safety of others; 
show common courtesy to fellow guests and staffs, and should not act in contrary, including but not limited to, the following: –

(i)  use of obscene language or behaviour deemed by TBT as indecent, offensive, disturbing, inappropriate, unsafe, illegal, or disruptive; 
(ii)  wearing or display of inappropriate attire including inappropriate exposure of the body which may impede order, safety or cause nuisance or disturbance to other guests or staffs; 
(iii)  spitting or any other unhygienic behaviour; and 
(iv)  obstruct or interfere with staffs in the exercise of their duties or execution of the Rules and/ or these terms and conditions.


To the fullest extent permitted by law, TBT, its employees, directors and agents are not liable to the Participant(s) or the Supervisor(s) for personal injury or death suffered by the Participant(s) or the Supervisor(s), save and except where this has arisen directly from the negligence of TBT. 
The Customer, the Participant(s) and the Supervisor(s) assume and accept all such risks and have to to indemnify, hold harmless and promise not to sue (and, if applicable, procure that the participant shall not sue) TBT for any and all liabilities or claims arising as a result of participation in the Activities or any activities incidental thereto, wherever, whenever, or however the same occur, whether caused by negligence or otherwise, except to the extent that TBT accepts liability at clause 9 above.


The Participant(s) and/or the Supervisor(s) agrees to receive treatment that may be deemed advisable in the event of injury, accident, and/or illness as a result of participating in the Activities. The Customer and/or the Supervisor(s) shall pay the cost of and authorises TBT to take all steps it considers reasonably necessary to protect his/her welfare in the event of personal injury, including the administration of any emergency medical treatment and ambulance transportation.


Except as set out in clause 9 above the Customer is fully liable for all medical expenses incurred as a result of any injury or property damage during participation by the Participant(s) in the Activities and/or the conduct of the Participant(s) or the Supervisor(s) the TBT Venue. 
The Participant(s) and the Supervisor(s) must look after their own belongings at the TBT venue. TBT is not responsible and do not assume any liability for any damage to or loss of the property or belongings of any guest, whether such damage or loss is caused by the negligence of TBT or otherwise. TBT reserves the right to handle all unclaimed properties without further notice. TBT is not responsible and do not assume liability for damage or loss of guest’s belongings or property.

TBT, in its absolute discretion, reserves the right to modify the Rules and these terms and conditions, change our operating dates and hours, remove or cancel all or any activities or areas within the TBT venue for any reason including but not limited to technical, health and safety and/or operational reasons or due to special events or private functions without prior notice. For the avoidance of doubt, the full value or any part of the value of the ticket will not be refunded nor will any compensation be payable if any of the advertised activities or areas are removed or closed during the visit.


TBT reserves the right to deny admission, or to require a guest already admitted to leave the TBT venue, without refund or compensation, for failure to comply with any of the Rules, these terms and conditions, for unsafe, illegal or offensive behavior, to ensure safety, security or order, or if TBT consider that the circumstances so require.


These terms and conditions are subject to the interpretation of TBT which shall be final and conclusive. In case of disputes, TBT reserves the right of final decision on the dispute.


If any part(s) of these terms and conditions are held invalid the remainder will continue in full force and effect. 
These terms and conditions are governed by the laws of the Hong Kong Special Administrative Region and that the venue for any legal proceedings shall be the courts of the Hong Kong Special Administrative Region. 
Admission to TBT venue signifies the agreement to these terms and conditions and the permission for TBT to take and use video or audio materials for educational and promotional purposes.

All visitors must read and agree to abide by the following rules before entering the venue of The Big Things Playground or participating in the activities held by this venue.


1) Security considerations
1.1) All visitors do so at their own safety risk.
1.2) We encourage children to interact with the facilities in the venue. When children are exploring freely in the venue, the institution/school/parents/caregivers are responsible for paying attention to the safety of the children and maintaining proper etiquette and order. At the same time, we also encourage adults to interact with children.
1.3) Adult visitors over the age of 18 must be responsible for the accompanying minor visitors and personal safety.
1.4) TBT Playground will not be responsible for any accident or injury to any visitor.
 
2) On-site food and drink
2.1) All visitors are not allowed to eat or drink in the venue.
2.2) Due to hygienic issues, the venue has the right to require visitors to properly dispose of the food and drinks they bring before entering the venue.
 
3) Apparel
3.1) Clothes should be comfortable and light.
3.2) Socks are required to enter the venue.
3.3) The venue will not be responsible for any soiling, damage or loss of visitors’ personal belongings or clothing during activities in the venue.
 
4) Property and facilities
4.1) Visitors must keep their personal belongings by themselves. The venue is not responsible for any damage or loss.
4.2) Visitors must enter the venue and enjoy the venue facilities at the specified admission time when purchasing tickets.
4.3) The venue will not be responsible for any damage or loss of temporarily stored personal belongings.
 
5) Loss or damage to the venue facilities and property
5.1) The playground staff will distribute wristbands to visitors when they enter the venue for identification and statistics purposes. If the visitor loses the wristband, he/she will not be issued a new wristband and will not be able to re-enter the venue.
5.2) If a visitor is found to be dishonestly using the wristband, the venue has the right to ask the visitor to leave the venue. The venue will not be liable for any losses and may claim compensation from them.
5.3) If the visitor damages the props or facilities in the playground in any other way, he will be required to pay a sum of money, the amount of which is determined by the director of the playground to repair or re-add the relevant items.
5.4) Visitors are required to provide contact information so that the game can claim compensation from them.


6) Copyright
6.1) The information, pictures, exhibits and publications displayed in the playground and on the website are owned by The Big Things Playground Limited.
6.2) Without the prior written authorization of The Big Things Playground Limited, the information shall not be altered, processed, adapted, reproduced and published for commercial and non-commercial purposes. Non-commercial use must be attributed to The Big Things Playground Limited, subject to written permission.
6.3) Although this venue has made every effort to ensure the accuracy of the information provided, this venue does not warrant, either expressly or impliedly, that such information is correct. Any loss, destruction or damage (including but not limited to consequential loss, damage, or damage), the venue shall not assume any legal responsibility, obligation or responsibility.
 
7) Sickness
7.1) Due to hygienic issues, visitors must bandage their wounds properly before touching the site facilities, otherwise the site has the right to refuse visitors to continue playing.
7.2) In order to ensure the safety of visitors and employees, this venue does not accept any appointments from people who are unwell or have obvious symptoms of respiratory infection. If the staff of the playground finds that the visitors have symptoms of upper respiratory tract infection such as fever or coughing, the venue will ask the relevant people to leave the venue immediately, and the relevant tickets will not be refunded or exchanged. The venue reserves the right of final decision.
 

8) It is strictly forbidden to bring the following items into the playground:
8.1) Dangerous, smelly or illegal items;
8.2) Any kind of weapon or any object that looks or looks like a weapon (including but not limited to toy guns, toy swords, etc.);
8.3) Any bag or luggage exceeding 39cm x 41cm x 49cm;
8.4) Trolleys, transport vehicles on wheels (except hand wheelchairs, baby carriages, and electric assisted mobility devices that travel at walking speeds) and recreational devices on wheels, including but not limited to skateboards, scooters, roller shoes and shoes fitted with pulleys;
8.5) Tripods, folding chairs and stools;
8.6) Any item that the venue considers to be harmful, cause confusion or interfere with the operation of the venue.
 
9) If visitors bring the above items, the venue will refuse their entry without any refund or compensation.
 
10) The following activities are strictly prohibited:
10.1) Using remote-controlled flying devices;
10.2) sell or advertise any item or service;
10.3) Unauthorized activities or speeches, or the use of any flags, banners or signs, or inciting crowds and other unauthorized gatherings of any kind.
 
11) If a visitor engages in the above activities, the venue will require the visitor to leave immediately without any refund or compensation.
 
12) Other
12.1) The venue will change the opening hours and the opening hours of specific venue facilities, modify rules, control the number of visitors, suspend or cancel activities, etc., depending on the capacity of the venue, special programs, bad weather, or any situation that the venue deems necessary. No prior notice is required, and no refund or compensation is required.
12.2) Without the written consent of this venue, no one is allowed to conduct any promotional activities and questionnaire surveys at this venue. If found, the venue has the right to ask visitors to leave the venue without any compensation.
12.3) Visitors are not allowed to bring animals or pets into the venue, except for animals approved for service purposes (eg: guide dogs), otherwise the venue has the right to refuse the person to enter the venue without any limitation or compensation.
12.4) Institutions/schools/parents/caregivers are not allowed to hold activities in this venue without authorization. If you have specific educational needs, please discuss the feasibility of the activity with the staff of this venue before visiting. The venue has the right to immediately stop any unauthorized activities.
 
13) Any personal information collected by this venue from visitors will comply with the Privacy Policy and Personal Information Collection Statement.

14) Once the payment is made, the visitor agrees to the above disclaimer and abides by the visit instructions. The visitor is also responsible for ensuring that all participants understand and agree to the above content.

15) The above detailed rules are written in Chinese and English. If there is any discrepancy or inconsistency between the texts, the English text shall prevail.

16) In case of any dispute, The Big Things Playground Limited reserves the right of final decision.

17) The above rules are governed by the laws of the Hong Kong Special Administrative Region of the People’s Republic of China.

I understand that admission to The Big Things venue signifies the agreement to the General Terms and Conditions of The Big Things Playground Limited and the permission for The Big Things Playground Limited to take and use video or audio materials for educational and promotional purposes.
